The Bossier Parish Police Jury met in regular and legal session on the 16th day of September, 2009, at 2:00
p.m., in the Police Jury Meeting Room, Bossier Parish Courthouse, Benton, Louisiana. The President, Mr. Glenn
Benton, called the meeting to order. The invocation was given by Mr. Wayne Hammack and the pledge of allegiance was
led by Mr. Bill Altimus. The Parish Secretary, Ms. Cindy Dodson, called the roll, with all members present, as follows:

Motion was made by Mr. Avery, seconded by Mr. Butler, to adopt the minutes of the August 5, 2009, and
August 19, 2009, regular meetings, and the August 19, 2009, Finance Committee Meeting, as published. Motion
carried unanimously.

Mr. Linc Coleman and Mr. Cody Peek, U. L. Coleman, presented information on the proposed Walker Place
Development near the CenturyTel Arena in Bossier City. Mr. Coleman stated that this development will be outstanding
for all of Bossier.
Mr. Peek stated that Walker Place is a proposed mixed-use development consisting of office, retail and
residential space. He stated that high-end offices and medical offices are planned along the Arthur Ray Teague Parkway,
and advised that acadiana style townhomes are proposed. Mr. Peek stated that neighborhood specialty retail shops and
restaurants are planned and stated that there will be a large amount of green space in the development.
Mr. Peek discussed the condition of the Barksdale Boulevard area, advising that this area should be considered
for redevelopment.
Mr. Coleman stated that access to the Parkway has been a problem, but stated that they hope to reach an
amicable resolution soon.

Ms. Dodson announced that the police jury will now convene as a Board of Tax Review to hear protests on
2009 tax assessments as established by the Bossier Parish Tax Assessor. Mr. Bobby Edmiston, Tax Assessor, and Mr.
Fred Alford, were present.
Mr. Edmiston presented the protest of Ronald Roy and Rose Ann Brocato Story, 108 Satinwood, Lot 136,
Correction Plat Dogwood South, Unit 7, Haughton, LA. Mr. Story was present. Mr. Story stated that his wife is 65 years
old and he was unaware of the opportunity to file for the Special Assessment Level. Mr. Edmiston stated that Mr. Story
is requesting that the assessment be retroactively reduced, and advised that in accordance with an opinion of the Attorney
General, this is not allowed.
Motion was made by Mr. Butler, seconded by Mr. Cummings, to uphold the assessment of property
owned by Ronald Roy and Rose Ann Brocato Story, 108 Satinwood, Lot 136, Correction Plat Dogwood South,
Unit 7, Haughton, Bossier Parish, LA, as established by the Bossier Parish Tax Assessor. Motion carried
unanimously.
RESOLUTION
WHEREAS, the Bossier Parish Police Jury met as a Board of Tax Review on September 16, 2009, in the Police
Jury Meeting Room, Bossier Parish Courthouse, Benton, Louisiana, for the purpose of hearing protests on 2009 tax
assessments as established by the Bossier Parish Tax Assessor, in accordance with the state law; and
WHEREAS, the following assessment was protested:

upheld as set by the Bossier Parish Tax Assessor, at $16,870.

Mr. Edmiston presented the protest of Purple Plum Properties, LLC, for Lots 1 and 2, Purple Plum Subdivision,
and for Lots 1 and 2, Shadow Ridge Estates Subdivision. He advised that these are vacant lots.
Mr. Bruce Waggoner, property owner, was present. He referred to the large number of people in the audience,
advising that most are residents of Shadow Ridge Estates Subdivision who have submitted a protest on their property.
Mr. Waggoner asked that he be allowed to speak on behalf of the group, advising that these protests have been filed due
to the FEMA floodway issue. Mr. Edmiston objected, advising that Mr. Waggoner can not speak for each person unless
he is the appointed taxpayer agent.
Mr. Waggoner requested that the Board of Tax Review be rescheduled for a time when his attorney can be
present. He presented a copy of each of the following suits which have been filed in the 26th Judicial District Court:

Mr. Waggoner stated that these residents feel that the value of their property has been greatly reduced due to the
determination of FEMA that this area is now in a floodway. Mr. Ford, Parish Engineer, stated that the owners may build
on these properties provided an engineering analysis is performed which must prove that the improvements have no
adverse effect on the water surface elevation.
Motion was made by Mr. Altimus, seconded by Mr. Cummings, to uphold the assessment of property
owned by Purple Plum Properties, LLC, at Lots 1 and 2, Purple Plum Subdivision, and at Lots 1 and 2, Shadow
Ridge Estates Subdivision, Bossier Parish, LA, as established by the Bossier Parish Tax Assessor. Motion carried
unanimously.

Mr. Edmiston presented the protest of James Bruce and Colleen Christine Waggoner for property at Lot 40,
Shadow Ridge Estates, 192 Shadow Ridge Drive, Bossier City, Bossier Parish, LA. Mr. Bruce Waggoner was present
and stated that in accordance with the new FEMA flood maps for Bossier Parish, his home is now located in a floodway
and the property value is greatly decreased.
Motion was made by Ms. Bennett, seconded by Mr. Altimus, to uphold the assessment of property owned
by James Bruce and Colleen Christine Waggoner at Lot 40, Shadow Ridge Estates, 192 Shadow Ridge Drive,

the value of his property has gone down due to the determination by FEMA that the property is now located in a
floodway. Mr. Edmiston stated that a 90% reduction in taxes is requested. Motion was made by Mr. Cummings,
seconded by Mr. Plummer, to uphold the assessment of property owned by Roger A. and Deborah A. Suiter at Lot
42, Shadow Ridge Estates, 188 Shadow Ridge Drive, Bossier City, Bossier Parish, LA, as established by the
Bossier Parish Tax Assessor. Motion carried unanimously.

police jury office prior to the meeting and presented to the Tax Assessor. Motion was made by Ms. Bennett, seconded
by Mr. Avery, to uphold the assessment of property owned by Figryanh, LLC, Fire Mountain Restaurant, 2400

Mr. Jackson, Parish Attorney, stated that the proposed ordinance identifies specific adjudicated properties and
declares the police jury’s intent to acquire a full ownership interest in these properties and begins the initial step of the 60-
day process for selling adjudicated property. He stated that the proposed ordinance authorizes the Parish Administrator to
send a notice to all parties who have an interest in these properties, and if the property is not redeemed within 60 days,
the police jury assumes ownership and the property can be auctioned for sale. Motion was made by Ms. Bennett,
seconded by Mr. Johnston, to adopt an ordinance declaring the police jury’s intent to acquire full ownership of
certain adjudicated properties. Motion carried unanimously.
ORDINANCE NO. 4307
AN ORDINANCE DECLARING INTENT TO ACQUIRE FULL OWNERSHIP INTEREST IN CERTAIN
ADJUDICATED PROPERTIES

WHEREAS, the Police Jury of Bossier Parish previously adopted Ordinance No. 4304 of 2009, providing for
the regulation of the acquisition of full ownership and merchantable title to adjudicated properties;
WHEREAS, the properties identified on Exhibit A have been previously adjudicated to Bossier Parish and
more than five years have elapsed from the filing of the tax sale certificate for each property; and
WHEREAS, the provisions of La. R.S. 47:2236 et seq. allow the Police Jury to declare, by ordinance duly
enacted, that it intends to acquire a full ownership interest in adjudicated properties.
NOW THEREFORE, BE IT ORDAINED, that:
Section 1: Claim of Ownership of Adjudicated Property.
A. The Police Jury of Bossier Parish, in regular session convened on the date set forth below, hereby
declares it intends to acquire a full ownership interest in the properties identified on Exhibit A in accordance with the
provisions of this Ordinance and La. R.S. 47:2236 et seq.
B. A copy of this ordinance shall be filed with the recorder of mortgages for Bossier Parish. The recorder
shall index the names of the tax debtor and the Parish of Bossier as mortgagees. A transfer, mortgage, lien, privilege, or
other encumbrance filed after the filing of the ordinance shall not affect the property. The recorder of mortgages or
recorder of conveyances shall cancel, erase, terminate, or release the acts upon the request of the Parish Administrator.
C. The Parish Administrator shall, within thirty days after the filing of the instrument and ordinance
described above, or as soon thereafter as practical, send a written notice regarding the acquisition to the tax sale parties
whose interest the Parish of Bossier intends to be terminated, that the party has until sixty (60) days after the date of the
notice to redeem the property or otherwise challenge in a court of competent jurisdiction the acquisition.
D. The notice shall constitute a notice of sale. The sending of this notice shall constitute service of the
notice of sale under Article VII, Section 25 of the Constitution of Louisiana. The notice required by this Ordinance shall
be sufficient, and it shall not be necessary to determine whether notice of the tax sale or any other notice was given. The
notice shall be sufficient if it conforms with La. R.S. 47:2236(C)(2).
E. The Parish Administrator shall cause to be published in the official journal of the Parish of Bossier a
notice that any tax sale party whose interest the Police Jury intends to be terminated has until sixty (60) days to redeem
the property or otherwise challenge in a court of competent jurisdiction the acquisition. The publication shall be
sufficient if it is in the form provided for by La. R.S. 47:2236(D)(2).
F. If the property is not redeemed within the time limit set forth in this Ordinance, the ordinance shall
become operative, and the Parish of Bossier shall acquire full ownership of the property, subject only to such rights as
determined by a final judgment rendered in an action filed within the time limits set forth in this Ordinance. The Parish
Administrator shall file a notice in the conveyance records indicating that the Parish of Bossier has acquired full
ownership of the property in compliance with this Section. The notice shall be sufficient if it conforms with La. R.S.
47:2236(E).
G. Contemporaneously with or subsequent to the filing of the notice, the Parish Administrator may file
with the recorder of mortgages an affidavit indicating how the tax sale parties whose interest the Police Jury intends to be
terminated were identified, how the address of each tax sale party was obtained, how the written notice was sent, the
results of sending the written notice, and the dates of publication. The affidavit may also contain a statement of the
interest to which the Parish of Bossier takes subject. The recorder of mortgages shall index the affidavit only under the
names of the Parish of Bossier and the tax debtor, as mortgagors. The affidavit shall be sufficient if it is in the form set
forth in La. R.S. 47:2236(F).
H. The filing of the affidavit provided in this Ordinance with the recorder of mortgages of Bossier Parish
shall operate as a cancellation, termination, release, or erasure of record of all statutory impositions of all political
subdivisions then due and owing, of all governmental liens, and of all interests, liens, mortgages, privileges, and other
encumbrances recorded against the property sold and listed in the affidavit.
Section 2. Sale of adjudicated properties owned by the Parish.
A. In the event Parish of Bossier acquires full ownership of any or all of the adjudicated properties
described in Exhibit A pursuant to the provisions of La. R.S. 47:2236 and Section 1 of this Ordinance, the Police Jury
hereby authorizes the Parish Administrator to sell said acquired adjudicated property or properties at public auction as set
forth in Ordinance No. 4304 of 2009.
B. The Parish Administrator may select any or all of the adjudicated properties acquired by the Parish as
listed on Exhibit A, for sale at public auction. The selection of these properties shall be in the sole discretion of the
Parish of Administrator and may be done in single parcels or in multiple lots.
Section 3. General
All Acts of Sale of adjudicated property shall contain provisions, acceptable in form and substance to the legal
counsel for the Police Jury, which provide that all such sales shall be for cash and shall be without warranty of title and
without any warranty of merchantability or fitness; shall be “as is, where is”; that it shall be the obligation of the
purchaser to obtain title insurance, if it is desired; that all such sales shall be subject to such encumbrances, liens,
mortgages, real charges or other burdens reflected in the public records; and that the Act of Sale for such adjudicated
property shall contain a condition which shall require the purchaser of such property to improve/renovate/make use of the
tract, to the satisfaction of Bossier Parish Police Jury, within 270 days of the passage of the Act of Sale and that, if the
purchaser fails to timely comply with this provision, Bossier Parish Police Jury shall have the right to dissolve or cancel
the sale.
Section 4. Severability
Should any part of this ordinance be declared null, void, invalid, illegal or unconstitutional, the remainder of the
said ordinance shall remain in full force and effect.
Section 5. Effective date
This ordinance shall become effective this 16th day of September, 2009.

and requested that the jury consider hiring Mr. John Dunlap to handle these matters due to the large number of possible
conflicts. Motion was made by Mr. Johnston, seconded by Mr. Butler, to approve the hiring of Mr. John Dunlap
to serve as the police jury’s legal counsel in the matter of two lawsuits filed, one from the residents of Pecan Grove
Subdivision and one from the residents of Shadow Ridge Estates. Motion carried unanimously.

Mr. Hammack reported on a meeting of the Capital Improvements/Building and Grounds Committee, advising
that the committee has no recommendations at this time. A meeting of the Building and Grounds Committee is scheduled
on October 7, 2009, at 1:30 p.m.

Ms. Dodson announced the public hearing to consider the application of the Bossier City-Parish MPC, for an
amendment to the Unified Development Code to clarify which zoning district aggregate storage is allowed in and to
remove the use “stockpiling of sand, gravel, or other aggregate” as an example of a warehouse and freight use. It was
requested that this matter be tabled, to be considered at the October 7, 2009 regular meeting. Motion was made by Mr.
Altimus, seconded by Mr. Hammack, to table the public hearing to consider the application of the Bossier City-
Parish MPC, for an amendment to the Unified Development Code, to be considered at the October 7, 2009 regular
meeting. Motion carried unanimously.

Ms. Dodson announced the public hearing to consider approval of the plat of the proposed development of

Mr. Altimus stated that grant funds in the amount of approximately $150,000 will be available for Bossier
Parish through the FY2009/2010 Local Government Assistance Program. He stated that these funds can be used for such

for the extension of water lines along Jamerson Road. Mr. Johnston advised of a request to extend water lines from the
Town of Plain Dealing to the Rocky Mount Road area.

Mr. Cummings advised Rusheon Middle School has requested that their request for discretionary funds for
walkie-talkies be removed from the agenda. The jury concurred. The walkie-talkies are used for security purposes.

Mr. Altimus presented information prepared by the staff regarding tax revenues and several projects which are
proposed, and requested the jury’s input and guidance on proceeding with future development in the parish. He stated
that year to date tax revenues are up by approximately 9.3%. Mr. Altimus stated that the Haynesville Shale should create
continued growth, and stated that he is very optimistic about the future of Bossier Parish.
Mr. Ford discussed funding for Sewerage District No. 1, advising that funds for Phase 1 and 2 of the project are
secure, which includes the East 80 Corridor to Highway 157. He stated that the purchase of Red Chute Utilities is
proposed as a temporary service until Phase 3 is complete. Mr. Ford stated that these oxidation ponds will be modified to
treat sewer temporarily until a permanent site along the Red River is found for construction of the treatment plant. He
presented a brief summary of the proposed schedule for the sewer district project.
Jurors were provided budget projections for the year 2009-2012 for the Highway Fund, Capital Improvements
Fund and the Capital Projects Fund. Mr. Altimus explained that the projections include an inflation factor to cover
increased costs.
Mr. John Holt and Mr. Jerry Osborne were present for discussion of low-interest funding available to the parish.
Mr. Holt stated that Bossier Parish qualifies for Super BABS bonds in the amount of $8,162,000, advising these are
taxable bonds and the Federal Government pays a portion of the interest rate. Mr. Osborne stated that these funds are
only available for 2009 and 2010 and could be used for special projects that have no designated funding. Mr. Altimus
recommended that if the jury decides to pursue the Super BABS bonds, they be set up on a 10-year payback, advising
that he does not recommend extending this any further than necessary.
Mr. Altimus provided jurors with a list of special projects which consisted of the Arthur Ray Teague Parkway
Extension, Old Palmetto Road, Pattridge/Parks Road, Wemple Road, Abe Martin Road and the Chalybeate Springs Road.
Mr. Jackson, Parish Attorney, stated that the Super BABS funds could be used to accelerate the Arthur Ray Teague

Parkway project and would allow the jury to continue with priority projects.
Mr. Osborne stated that the Super BABS bonds must be sold by the end of 2010. Mr. Altimus requested that
jurors review the information presented for consideration at a later date.
