PresentingtheClaimorDefense
Whenthejudgeisreadytohearthecase,theclerkor
judgewillcallthenamesofallplaintiffsanddefendants
inthecase.Theplaintiff,defendant,andanywitnesses,
shouldthengoforwardtothetableinfrontofthe
judge.Theplaintiffwillpresentevidenceandwitnesses
first,andth
enthedefendantwillpresentevidenceand
witnesses.
Judgment
Afterhearingbothsidesofthecaseandlookingatthe
evidence,thejudgewillmakeadecisionandrendera
judgmentbasedonthelawandthefactspresented.
DefaultJudgment
Sometimes,oneofthepartiesdoesn'tcometothe
smallclaimshearing.Ifthedefendantdoesn'tappear,
thejudgewillconsidertheplaintiff'sevidenceand
decidethecase,evenifthedefendantisabsent.If
sufficientevidenceisprovided,thejudgemayaward
theplaintiffsomeoralloftheamountclai
med,and
possiblyalsocourtcostsandinterest.

AFTERTHETRIAL
